Please read these Terms of Use (“Terms“, “Terms of Use“) carefully before using the MILLENNIUM HOSTING website (the “Service“) operated by MILLENNIUM HOSTING (“us“, “we“, “our“).

These Legal Terms constitute legally binding agreement made between you, where personally or on behalf of ean entity (“you”), and MILLENNIUM HOSTING concerning your access to and use MILLENNIUM HOSTING products, services and billing. By accessing MILLENNIUM HOSTING or using products, services, billing and support you agree to be bound by these Terms.

MILLENNIUM HOSTING Services are intended for users who are at least 18 years old.  Persons under the age of 18 are not permitted to use or register for MILLENNIUM HOSTING Services.

OUR SERVICES

The information provided when using MILLENNIUM HOSTING Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distributor or use would contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.  Accordingly, those persons who choose to purchase MILLENNIUM HOSTING products and access MILLENNIUM HOSTING services from other locations do so on their own initiative and are solely responsible for compliance with the local laws, if an to the extent local laws are applicable.

INTELLECTUAL PROPERTY RIGHTS

Our Intellectual Property

The Services, products and its original content, features and functionality are and will remain the exclusive property of MILLENNIUM HOSTING and its developers.

MILLENNIUM HOSTING are the owner or licensee of all intellectual property rights in MILLENNIUM HOSTING products and services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the MILLENNIUM HOSTING (collectively, the “Content“), as well as the trademarks, service marks, and logos contained therein (the “Marks“).

Our Content and Marks are protected by copyright and trademark laws (various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world.

The Content and Marks are provided in or through MILLENNIUM HOSTING “AS IS” for your personal, non-commercial use or internal business purpose only.

Your use of our Services

Subject to our compliance with these Legal Terms, including the “PROHIBITED ACTIVITIES” section below, we grant you a non-exclusive, non-transferable, revocable license to:

• access MILLENNIUM HOSTING Services; and
• solely use MILLENNIUM HOSTING Products and Services for your personal, non-commercial use or internal business purpose.

We reserve all rights not to expressively grant you in and to the Products, Services, Content, and Marks owned by MILLENNIUM HOSTING.

Any breach of these intellectual Property Rights will constitute a material breach of our Legal Terms and your right or ability to use our Services will terminate immediately.

Any purchase agreements, invoicing and recurring payments are non-refundable.

USER REPRESENTATION

By using MILLENNIUM HOSTING, you represent and warrant that:

• all registration information you submit will be true, accurate, current and complete;
• you will maintain the accuracy of such information and promptly update such registration information as necessary;
• you have the legal capacity and you agree to comply with these Legal Terms;
• you are not a minor in the jurisdiction in which you reside;
• you will not access MILLENNIUM HOSTING Services through automated or non-human means, whether through a bot, script or otherwise;
• you will not use MILLENNIUM HOSTING Products, Services and Content for any illegal or unauthorized purpose; 
• your use of MILLENNIUM HOSTING Products and Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate our account, services and refuse any and all current or future use of MILLENNIUM HOSTING Products and Services.

USER REGISTRATION

Your registration and use of our Products

It is required to register when purchasing MILLENNIUM HOSTING Products.

Your registration and use of our Support, Services & Billing portal

It is required to register to access our MILLENNIUM HOSTING Services & Billing portal to view/manage services, view/manage recurring billing, support ticket, expiry or billing notifications and service login details.

By using MILLENNIUM HOSTING Services, you represent and warrant that:

• all registration information you submit will be true, accurate, current and complete;
• you will maintain the accuracy of such information and promptly update such registration information as necessary;
• you agree to keep your password confidential and will be responsible for all use of your account and password;
  
• we reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such a username or email is inappropriate, obscene, or otherwise objectionable.
• agree to access to MILLENNIUM HOSTING Services and Billing portal, view & manage services, view & manage recurring billing pdf statements for subscription services and service account login details.
• you agree to manage your direct PayPal account.  See Subject to our compliance with these Legal Terms, included in the “RECURRING INVOICING AND PAYMENTS” section below.
• you will provide details when submitting a support ticket; although, we prefer our primary dedicated Customer Support application for quicker response as response time for online support tickets varies from 12 to 24 hours.

Your registration and use of our Discord Support server

It is required to download and register with Discord to access our MILLENNIUM HOSTING Support server for technical, and or billing support.

MILLENNIUM HOSTING Support Services requires all subscribers to adhere to all Customer Support requirements, respectfully observe office hours and be privy to known issues and Services updates prior to submitting a support ticket.

By using our MILLENNIUM HOSTING Discord Support server, you represent and warrant that:

• you agree that it is mandatory to download, register and access Discord applications via iOS and Android devices or web versions; besides our web portal, this is our main source of communication, announcements and support.
• we reserve the right to use Discord as our primary means of supporting our customers – no other application will be advised, used;
• all registration information you submit will be true, accurate, current and complete;
• you will maintain the accuracy of such information and promptly update such registration information as necessary;
• you agree to keep your password confidential and will be responsible for all use of your account and password;
  
• we reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such a username or email is inappropriate, obscene, or otherwise objectionable.
• you have general knowledge of home networks, internet service providers, and media devices.
• you do your due diligence by reviewing announcement emails, or chats about known or ongoing issues, attempt to troubleshoot on your own prior to requesting for support.
  
• you complete the required support ticket template details for issues. If not, this will delay support and resolution if not properly filled out as support agents reserves the right to delay in response if details are not properly submitted, agents will close tickets if there’s no response within a respectable time frame;
• do not private message or direct message Admins;
• agree to respect MILLENNIUM HOSTING support hours; allow 4-8 hours for a response, sometimes sooner.  Be patient with details.
• agree to contact Discord support for application, login, username or authentication issues.

PRODUCTS

All products are subject to availability, and we cannot guarantee that items will be in stock.  We reserve the right to discontinue any products, refuse refunds, and return at anytime for any reason. Prices for all products are subject to change.

PURCHASES AND PAYMENTS

MILLENNIUM HOSTING ONLY accepts PayPal as a form of payment through our MILLENNIUM HOSTING website, services & billing portal.

By using our MILLENNIUM HOSTING website to purchase products and services, you represent and warrant that:

• you agree to provide current, complete, and accurate purchase and account information for all purchases made via MILLENNIUM HOSTING
• you further agree to promptly update account and payment information, including email address, payment method using PayPal so that we can complete your transactions.
• you agree to pay all charges at the prices then in effect for your purchases and any applicable shipping, programing fees, and you authorize use to charge you by PayPal method ONLY;
• you agree that if a purchase order is subject to recurring charges, then you consent to MILLENNIUM HOSTING recurring invoicing to charge preferred method or PayPal method on  recurring basis.  See Subject to our compliance with these Legal Terms, included in the “RECURRING INVOICING AND PAYMENTS” section below.

Sales tax will be added to the price of purchases as deemed required by MILLENNIUM HOSTING

MILLENNIUM HOSTING reserve the right to change prices at any time.

MILLENNIUM HOSTING reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

MILLENNIUM HOSTING reserves the right to refuse any order placed through the MILLENNIUM HOSTING website.

MILLENNIUM HOSTING may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. 

The restrictions may include:

• orders placed by or under the same customer account;
• the same payment method, and/or orders that use the same billing or shipping address;

MILLENNIUM HOSTING reserve the right to limit or prohibit orders that, in our sole judgement, appear to be placed by unauthorized dealers, resellers or distributors.

RETURN POLICY

MILLENNIUM HOSTING will accept a return of an unused product within 7 days.

By returning MILLENNIUM HOSTING products, you represent and warrant that:

• you agree to be subjected to a $10 return shipping label fee;
• you agree to be subjected to a $20 repackaging and re-programming fee;
• you agree that discount or promotional items are not eligible for a return;
• agree that MILLENNIUM HOSTING will not accept returns or process refund requests due to unforeseen issues, or negligence such as, product placement, is in unsuitable condition, not understanding basic home network setup, functions and internet service provider speeds and packages

IMPORTANT NOTE: It is recommended prior to purchase, that you should have at least 2GB of network speeds, understand basic internet troubleshooting as our products and services must function successfully with stable internet connections.

• agree that we will not issue refunds for products purchased through other entities, such as distributors or retail partners;
• agree that MILLENNIUM HOSTING cannot be held responsible for item(s) damaged or lost in return shipment, therefore we recommend an insured and trackable mail service;
• agree MILLENNIUM HOSTING will not issue a refund without actual receipt of the item(s) or proof of purchase return delivery.

Once paid, a return shipping label will be emailed directly to you. Once we receive the returned item(s), MILLENNIUM HOSTING will then give a full refund (excluding shipping and service fees as we are unable to refund the initial shipping cost of your order). Please allow 1-2 weeks for your return to be processed.

DISCLAIMER

MILLENNIUM HOSTING SERVICES ARE PROVIDED ON AN  AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE MILLENNIUM HOSTING SERVICES WILL BE AT YOUR SOLE RISK.  TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH MILLENNIUM HOSTING SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.  WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE MILLENNIUM HOSTING SERVICES CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO MILLENNIUM HOSTING SERVICES AND WE WILL ASSUME  NO  LIABILITY OR RESPONSIBILITY FOR ANY: 

1. ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS;
2. PERSONAL INJURY, PRODUCT OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO USE OF MILLENNIUM HOSTING PRODUCTS AND SERVICES;
3. ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORE THEREIN; 
4. ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM MILLENNIUM HOSTING PRODUCTS AND SERVICES;
5. ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH MILLENNIUM HOSTING PRODUCTS AND SERVICES BY ANY THIRD PARTY, AND/OR;
6. ANY ERRORS OR  OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE ISSUE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA MILLENNIUM HOSTING PRODUCTS AND SERVICES.  WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH MILLENNIUM HOSTING, ANY HYPERLINKED WEBSITE, OR ANY WEBSITE OR MOBILE APPLICATION FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND WE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND ANY THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES.  AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGEMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

LIMITATION OF LIABILITY

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons than the negligence of MILLENNIUM HOSTING and that damages resulting from any interruption of service are difficult to ascertain.

Therefore, Subscriber agrees that MILLENNIUM HOSTING shall not be liable for any damages, or the unforeseen arising from such causes beyond the direct and exclusive control of MILLENNIUM HOSTING.

Subscriber further acknowledges that MILLENNIUM HOSTING liability for its own negligence may not in any event exceed an amount equivalent to charges payable by Subscriber for services during the period damages occurred. In no event shall Millennium Hosting be liable for any special or consequential damages, loss or injury and non-payment due to unforeseen circumstances or mistakes.

MILLENNIUM HOSTING is not responsible for any damages your “business” or personal entity may suffer.
MILLENNIUM HOSTING is not responsible for any unforeseen events or negligence that may prevent Subscriber from continuing services or use of products.
MILLENNIUM HOSTING is not responsible for Subscriber failing to execute due diligence by managing both direct PayPal account & MILLENNIUM HOSTING Services & Billing portal as MILLENNIUM HOSTING is only responsible for automated billing, product & services system that creates and sends recurring subscription invoices for collecting payments through PayPal integrated systems & MILLENNIUM HOSTING Services & Billing.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF MILLENNIUM HOSTING PRODUCTS AND SERVICES, EVEN  IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  NOTWITHSTANDING ANYTHING THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOUR FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED.

SUBJECTED TO CHANGES

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use MILLENNIUM HOSTING Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using MILLENNIUM HOSTING Service.

GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of United States without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
